Lindsay Lohan avoided more jail time today when she was ordered back to a drug and alcohol rehab program until January. In August, she served two weeks of a 90-day jail sentence for violating probation in the 2007 case only to be released and then to test positive for cocaine in a court ordered drug test.
Prosecutor Danette Meyers said Friday she asked the judge to send the actress to jail for 180 days. Meyers argued that Lohan has a pattern of checking into rehab “every time she has a violation and jail is leering over her head.” Lohan is currently being treated at the Betty Ford Center in southern California in what is her fifth stint in rehab in three years.
TMZ has obtained Probation Department documents where Lindsay apparently told her probation officer that continued inpatient treatment would be a hardship financially, and damaging to her career. It is reported that she is concerned about her clothing line and a movie she is scheduled to start filming in November (the director has stated that he will wait for her).
I think that one can understand that this young lady would have concerns about her career and business dealings. However, the time is now for Ms. Lohan to come to grips with her addiction and take this opportunity that the judge gave her today to concentrate on a successful recovery. The judge said that if Lohan slips again after her release in January, he’d sentence her to six months in jail.
Do you think that sending Ms. Lohan back to rehab is the right move or was the prosecutor justified in asking for six months of jail time? Keep in mind that this is Ms. Lohan’s fifth stint in rehab.

I really have mixed feelings. On the one hand, I am cognizant (as I think most of us are), of how dysfunctional Lohan’s family life has been. Anyone with Michael Lohan for a father and Dina Lohan for a mother deserves as much sympathy as possible, IMO. On the other hand, I’m aware that in many ways, Lindsay Lohan has had a lot of privileges – been given a lot of second chances – that the average drug addict hasn’t been given. I sincerely hope that she takes advantage of them this time and gets her life in order.
Personally I do think this is the right move by the judge…for now. She does has a pretty serious addiction which is evident in her behavior immediately after being released from jail in August. She needs help.
However, if she violates parole after her release from rehab in January, I think maybe jail time will be needed. More extensive jail time than 10 days or whatever she received in August.
I think she probably needs to make other changes in her life and hire someone to help her manage her business dealings other than her one of her parents. Her parents need to be just that. Her parents.
I’m not a big fan of jailtime for drug addicts. Drug dealers? That’s a different story.
I’m not a fan of jailtime for drug addicts either. It is frustrating to me though that if Lindsay Lohan was a non-celebrity she’d be in jail serving a 10-15 yr sentence. The law reallly should reflect some continuity. It’s also unfortunate that there are people w/addictions that are on waiting lists to get into rehab & this young woman seems to come & go as she pleases.
When I read things like this about celebrities, I have to wonder just how in touch they are with reality. People die from drug addictions every day, all over the world. To hell with clothing lines and movies, get to rehab, take it seriously, take advantage of all the opportunities given that no one else gets,and get better. A clothing line is no good to someone once they’ve passed away. What I can’t believe is that her obviously unhinged mother isn’t scared out of her mind over what’s going to become of her daughter. I honestly think if I were Lindsay Lohan and my mother were Dina Lohan, I would be tied up and dragged to rehab if that’s what it took. There would be no judge getting involved to tell me I need rehab. I’m just interested to see where Lindsay Lohan is in a years’ time. Anyone else?

I totally agree. Dina seems to be in her own little world. Unless what she is saying publically is radically different from what she really thinks.
I see no reason for Lohan to be in jail. And I am not sure what special priviledges she has gotten. I keep hearing she is being treated differently, but I haven’t seen any proof of this. It may well be there and I just haven’t seen it. These minor drug crimes aren’t reported in the news, so I may just be naive as to the number of drugs users like Lohan who are being sentenced to jail.
One other thing. As a California tax-payer, I am happy to not have to house Lohan for the next xx days. It’s money we don’t have and would serve no purpose in my mind.

Ann, yes there are waiting lists. My brother was on a couple & the only reason he got in as soon as he did was because my mom took him to the ER- he was beyond rock bottom. His doctor came in to see him & wrote an emergency admit. He is now 3 yrs clean!
Anya- move to the midwest- all you will see in the news is story after story about meth labs, addicts & dealers. There was a habitual offender in my home town that had been caught w/a lab while on probation. The man is serving 30 years. He was definitely made an example to the rest of the community.
I believe Dina Lohan is an enabler. From the media, it looks as if she’s in denial. The whole family needs therapy, & I’m not talking about some crap Hollywood “therapy” either. Some good ole’ fashioned therapy, away from the celebrity world.
I also wanted to say regarding Lindsay Lohan going to rehab for the 5th or 6th time, that if SHE doesn’t want to get better, it doesn’t matter how many times the court MAKES her go to rehab- there isn’t some magic number.
There is a great book by James Frey, “A Million Little Pieces.” It received a lot of backlash after Oprah had put it in her book club, claiming it was non-fiction. Frey eventually came out & said that he did fluff it up a bit. Regardless, it’s a good book. My whole family read it, including my brother (who’s recovering) & we all walked away with a better understanding of addiction & recovery.
I don’t support jail time for addicts either, (DUI is another story. I’m afraid if she doesn’t get clean soon she will overdose. I hope that doesn’t happen. I think Dina is in deep denial. Ridiculous denial. The kind where you don’t want to see the truth. I am not by any means a Michael Lohan fan- he goes about it in all the wrong ways, but I think he genuinely wants help for her and truly realizes how bad it is.
I read that book also before it was revealed on Oprah that he had embellished a great deal. It didn’t matter to me. The story and the message were the same regardless of how real life it was. I was glad I read it
Celebrity rehab must be the worst kind of rehab. You have someone selling your story to all the news outlets. Both of her parents have lived off her for many years, way past the age of 18 when it comes to Lindsey. Neither one of them has a job, but they seem to run to the rehab door to protect their interest, nit their daughter. I do feel sorry for her, but it’s up to her now!! She is an adult, it’s her addiction, and she can do it if she wants to. I hope the best for her and all others that have a struggle with addictions in their lives.
What a joke. Talk about justice not being served. Any other Joe Blow would have already been in jail. She’s not going to get serious about her recovery because she has too many people enabling her including the legal system and her ding-bat mother.
It’s useless. They will find a way to get her out early and it will be right back to where we started with Dina Lohan going “ummm, errr….that judge was mean and you just don’t get it.” This is a sick person. It’s not just addiction, I’m calling mental illness and until people actually love her enough to do the right thing, she’s going to have a long, hard life.
Color me skeptical about Micheal Lohan’s intentions, Sam. Even a broken clock is right twice a day. I think if he were primarily concerned about her, he would have handled everything privately and lovingly.

I agree- he is broken in a major way. He doesn’t handle anything correctly. I believe her mom loves her- but enables and refuses to recognize the problem. While her dad is a disaster and has made so many mistakes its ridiculous (also I think he’s a media fiend), I think he’s the only parent that sees her addiction for what it is. I don’t know if his intentions are 100% pure, but I do think he wants her to get the help she needs.
